These fees are determined based on the home’s circle rate and other parameters. In MP, stamp duty and registration charges are the responsibilities of the registration and stamps department. This department is also one of the highest revenue-generating departments of the state. The department is divided into four regions in Bhopal, Gwalior, Jabalpur and Indore. Each of these regions is managed by a Zonal Deputy Registration Inspector General (DG). There are 51 Registrar offices in each district and 234 Registrar’s offices in each state.

The overall registry fee includes municipal and panchayat fees, if applicable. Principal stamp duty (5% -2% cess), Municipal stamp duty (3%), District stamp duty (1%), and Upkar stamp duty (0.5%).

Stamp Duty in MP on Under-Construction Properties

Here’s a simple analysis of how stamp duty charges work in Madhya Pradesh for properties that are under construction.

  1. The rate remains unchanged.

The MP government charges 10.5% (7.5% Stamp Duty + 3% Registration Fee) I.e. it does not matter whether the construction site is still a hole in the ground or is fully constructed.
However, they do not collect it in one go. Typically, you pay a nominal amount when you sign the first “Agreement” (Booking) and the rest becomes payable in full when the construction work is finished and you receive the keys.

  1. GST. (The “Under-Construction” tax)

This is where you could lose or save some money.

  • If it’s Under-Construction: You are REQUIRED to pay GST to the builder.
  • If the flat is “Affordable” (usually under Rs. 45 Lakhs), GST is 1%.
  • If it is a normal/luxury flat, GST is typically 5%.

The moment the flat becomes Ready-to-Move, it is important to note that the builder will not charge GST after they obtain the “Completion Certificate” (CC).

In layman’s terms, buying a property that is still under construction means you will pay 10.5% (Registry) + 5% (GST) = 15.5% in tax. However, in essence, buying a property that is fully constructed also excludes you from having to pay that 5% GST.

  1. Why Customers Continue to Buy Off-Plans?

While you do pay 5% extra GST, people do it because:
Lower Base Price: Developers offer “paper” (not built) flats at a lower price than what they will be sold for once completed, estimated to be around a 20% increase.
Flexible Payment Plans: The entire registry amount does not need to be available. The large portion of the 10.5% registry fee can be paid only at the end (time of possession).

  1. Beware of “Guideline Rates”

In MP, there are state mandated “Sarkari Rate” (Circle Rate) for every colony.
Suppose your builder quotes a price of Rs. 40 Lakhs as “discounted”, but the government values that piece of land at Rs. 45 Lakhs, you will have to pay 10.5% on Rs. 45 Lakhs.

On the upper right-hand corner of the window, click on Login and enter your credentials. On the left-hand side, click on Property Valuation and Duty Calculation. Select Duty Calculation. Once the next window opens, fill in your name, address and the other required fields, and select the deed category and type. Click on Validate to confirm the information. The relevant duty will be shown.

Sampada 2.0 portal is an initiative by the government of Madhya Pradesh to facilitate online registration of properties. All the required services are available to the property buyers through this portal. The following are the steps to calculate the stamp duty in Madhya Pradesh through the Sampada 2.0 portal.

Step 1: Visit the Sampada 2.0 online portal and click on the Stamp Duty/Registration Fees Calculation option at the top of the homepage.

Step 3: After finishing this, you will have to enter some other details like the category of the deed, the type of the deed, etc. and then you will be able to continue to the calculation of stamp duty and registration charges.

Step 4: Hit the Submit button to continue to the calculation of stamp duty and registration charges.
